There is a large body of law that governs your right to recover for personal or property injuries you sustained. A Court will consider, among other factors, what caused the injury, whether it was a “slip and fall,” whether a defective product was involved, an automobile, or was the act negligent or intentional. A Court will also inquire as to when and where the accident occurred. There are requirements for giving timely notice of your claims. A “Statute of Limitation” may require you to file a lawsuit within a certain time limit. If you don’t give timely notice, you may forever lose your ability to obtain recovery. Damages are defined as loss or harm resulting from injury to a person, property or reputation. It also refers to compensation — such as a money judgment — provided to a person who has suffered a loss or harm due to the unlawful act or omission of another. The person at fault, the one who is the proximate cause of the loss or injury, must compensate the injured party.
